1 Acceptance of terms

These Terms of Use ("Terms") are a legal agreement between you and Giddy: Roleplay Chat & Stories ("Giddy", "we", "us", or "our").

By downloading, accessing, or using the Giddy app or website (the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2 Eligibility & age

You must be at least 13 years old to use Giddy. If you are under the age of majority in your country, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

3 Your account

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Notify us immediately if you suspect unauthorized use of your account.
• You may not share, sell, or transfer your account to anyone else.
• We may suspend or close accounts that violate these Terms.

4 License to use Giddy

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own, non-commercial entertainment. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the app except as permitted by law.

5 AI-generated content

Giddy uses artificial intelligence to generate characters, replies, and stories. You understand and agree that:

• All characters and conversations are fictional and created for entertainment only.
• AI output may be inaccurate, incomplete, or unexpected, and does not represent the views of Giddy.
• AI content is not professional advice (medical, legal, financial, or otherwise) and should not be relied upon as such.
• You should use your own judgment and not treat AI characters as real people.

6 Your content

You retain ownership of the original content you create in Giddy, such as custom characters and stories ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free license to host, store, process, and display it as needed to operate and improve the Service.

You are solely responsible for Your Content and confirm that you have the rights to share it and that it does not violate these Terms or any law. We may remove content that breaches these Terms.

7 Acceptable use

To keep Giddy safe and enjoyable, you agree not to:

• Use the Service for anything illegal, harmful, or abusive.
• Create or share content that sexualizes minors, promotes violence, self-harm, terrorism, harassment, or hate.
• Attempt to bypass safety filters, age restrictions, or content moderation.
• Impersonate others or misrepresent your identity or affiliation.
• Upload malware, spam, or attempt to disrupt, overload, or hack the Service.
• Scrape, data-mine, or use automated systems to access the Service without permission.
• Use Giddy or its AI output to build a competing product or dataset.

8 Subscriptions & purchases

Giddy may offer optional in-app purchases and subscriptions ("Premium"). The following applies:

• Prices and features are shown in the app before purchase. Payments are processed by the Apple App Store or Google Play, subject to their terms.
• Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours beforehand.
• You can manage or cancel subscriptions in your app store account settings.
• Except where required by law, payments are non-refundable. Refund requests are handled by the relevant app store.
• We may change pricing or features going forward; changes will not affect a billing period you have already paid for.

9 Intellectual property

The Service — including the Giddy name, logo, software, design, and all original content we provide — is owned by Giddy or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers those rights to you except for the limited license described above.

10 Termination

You may stop using Giddy and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your license ends and we may delete your data as described in our Privacy Policy. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

11 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations. You use Giddy at your own discretion and risk.

12 Limitation of liability

To the maximum extent permitted by law, Giddy and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or the minimum permitted by applicable law.

13 Governing law & disputes

These Terms are governed by the laws applicable in the jurisdiction where Giddy operates, without regard to conflict-of-law principles. You agree to first try to resolve any dispute with us informally by contacting us. Any dispute that cannot be resolved informally will be handled by the competent courts of that jurisdiction, subject to any mandatory consumer-protection rights you have where you live.

14 Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. By continuing to use Giddy after the changes take effect, you accept the updated Terms.
